These terms apply to all sales of products from our online shop to consumers, whether domestic (in Norway) or international. The customer’s order confirmation and these terms together constitute the full agreement for the transaction.
1. Jurisdiction and Applicable Law
Our webshop is based in Norway, and all sales are governed by Norwegian law. This applies to both Norwegian and international customers. By making a purchase, you agree that any transaction will be governed by the following Norwegian acts:
- The Norwegian Act relating to consumer purchases (Forbrukerkjøpsloven)
- The Norwegian Act relating to a cooling-off period in connection with certain contracts for consumer purchases (Angrerettsloven)
2. Prices
Prices listed on our webshop include 25% VAT, applicable under Norwegian law. We reserve the right to adjust our prices accordingly if VAT, taxes, or other fees change. For international customers, any additional customs duties, taxes, or import fees applicable in your country will be your responsibility.
Shipping prices will vary depending on the destination country and will be calculated at checkout or upon contacting us for international shipments.
3. Order Confirmation
All orders are considered binding once confirmed. You will receive an order confirmation via email containing all necessary information regarding your purchase. As your order is processed, you will receive additional updates via email.
4. Shipping
For customers in Norway, products should be available for pick-up at your local post office within 3-7 business days after we receive your order. The post office will notify you when the package is ready for pick-up.
For international orders, products will be shipped within 3 workdays.
Please note that our delivery estimates are approximate and not guaranteed. We take no responsibility for any delays or failures in delivery times caused by unforeseen circumstances, carrier delays, customs processing, or any other factors beyond our control. If your order is held up at customs, it may result in further delays.
You have two weeks to pick up the package from your local post office. If you do not pick up the package within this time, it will be returned to us per post office regulations, and you will be invoiced for the delivery costs.
5. Shipping Prices
Shipping prices are listed at checkout and will vary depending on the destination and the agreements we (Polar Bear Tactical) have with different carriers. The final shipping cost will be calculated based on where in the world your order is being sent.
6. Right to Cancel the Order and Return the Product(s)
6.1 Right to Cancel the Order
You are entitled to cancel your order under Norwegian law. The transaction is not complete until you have seen and approved the product. If you regret your purchase, you may notify us via email and return the product within 14 days from the day you received it (the "cooling-off period"). If we did not provide you with clear documentation of your right to cancel, the cooling-off period extends to 3 months.
Conditions for Returning a Product:
- The product must remain unused and in resalable condition.
- All labels must still be attached, and the original packaging must be included.
- While you can return a product without providing a reason, we encourage you to include a brief explanation on the return form.
If you exercise your right to cancel, you are responsible for paying the return shipping costs. Once we receive the product in undamaged condition, we will refund the cost of the product, including any initial shipping fees, within 30 days. Please include your bank account details on the return form to facilitate quicker refunds.
6.2 Right to Cancel the Order (International Customers)
International customers are also entitled to cancel their purchases under Norwegian law within the 14-day cooling-off period. The same terms apply: products must be unused and returned in the same condition as when received. Return shipping fees will be your responsibility.
In case of any conflict or dispute, you may contact the Norwegian Consumer Council (Forbrukerrådet) or relevant local consumer offices for assistance. We encourage you to review the details of your right to cancel, which we will provide with each order.
6.3 Defects in the Product - Buyer's Rights and Claim Period
If a product has a defect, you must inform us within a reasonable time after discovering, or when you should have discovered, the defect. Notification within two months of discovery is always considered timely. Claims may be made up to two years from the date of receipt.
If the defect is not due to your actions or conditions on your part, you may, under Chapter 6 of the Consumer Purchases Act, withhold payment, choose repair or replacement, request a price reduction, cancel the purchase, and/or claim compensation from us. To ensure clarity, we recommend making claims in writing.
6.3.1 Repair or Replacement
You may choose either repair or a replacement of the defective item. However, we may oppose this if fulfilling the demand is impossible or would result in unreasonable costs. Repairs or replacements will be completed within a reasonable timeframe, and we are generally limited to two attempts to correct the same defect.
6.3.2 Price Reduction
If the product is not repaired or replaced, you may demand a reasonable price reduction. This reduction should correspond to the relationship between the product's value in its defective condition and its contractual condition. In special cases, the reduction may be set based on the defect’s impact on you.
6.3.3 Cancellation
If the product is not repaired or replaced, you may cancel the purchase if the defect is significant.
7. Force Majeure
If an event beyond our control makes it impossible for us to meet our obligations under this agreement, such as changes in laws, strikes, lockouts, war, rebellion, fire, explosion, or government actions, our obligations will be suspended for the duration of the extraordinary situation. This includes sudden changes in product labeling requirements, bans on sales, or other public authority decisions affecting the market.
8. Information Provided by the Online Shop
We strive to provide accurate and up-to-date information. However, typographical or printing errors may occur. In such cases, we may not be able to supply products in accordance with the information provided on our website or in marketing materials.
9. Conflict Resolution
Please direct any complaints to us within a reasonable time, as outlined in Sections 6 and 6.3. We aim to resolve any disputes amicably. If we are unable to reach a resolution, you may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation. 10. Personal Data
We are responsible for processing the personal data we collect. Unless you agree to other uses, we will only collect and store the personal data necessary to fulfill our obligations under this agreement, in accordance with Norwegian data protection law.
